Your Rental Agreement is the document you sign when you collect your rental vehicle (it is generally entitled “Rental Agreement” or “Rental File”)

It specifies the details of your rental (e.g.: duration, services chosen and an estimate of the charges). By signing this document, you acknowledge that you have read and accepted the information and the special as well as general rental terms and conditions.

The Rental Agreement is concluded with the Hertz franchisee company, namely STLV Hertz – Tunisie.

The general rental terms and conditions govern all transactions made. Any order placed on the website hertz.com constitutes the Customer's unconditional and irrevocable acceptance of these terms and conditions.

The general rental terms and conditions form an integral part of the rental agreement.

a) Start of the rental

The rental date in principle starts upon delivery of the vehicle by STLV Hertz Tunisie to the Renter. The date and time of departure are specified in the named rental agreement.
This date also constitutes the start date of the rental under the agreement notwithstanding the Renter's presenting themselves to take delivery of the rented vehicle; STLV hertz Tunisie reserves the right to be paid for the entire rental period of the vehicle immobilised as a result of the booking made by the Renter in question.

b) Rental period:

The Renter undertakes to return the vehicle to the Lessor on the date set in the rental agreement, failing which they expose themselves to civil and criminal legal proceedings.
The rental period is calculated in blocks of 24 hours, which cannot be split, from the time the vehicle is made available.
For any delay a one-hour grace period is allowed; beyond that, an additional rental day will be invoiced.

If you wish to renew the agreement, it will be up to you:

  • To go, with the vehicle, preferably to the STLV HERTZ Tunisie departure branch, failing that to the nearest branch.
  • To carry out an inspection of the vehicle with the STLV - HERTZ Tunisie agent.
  • To pay the rent and additional charges upon closing of the expired agreement and to sign a new agreement.
c)End of rental:

The rental ends with the return of the vehicle, its keys and its documents (registration certificate, insurance, tax disc, etc.) at the Lessor's counter, to an STLV Hertz Tunisie agent.

Under no circumstances shall you return the documents and the keys to persons outside the STLV Hertz Tunisie service, or to persons present in the car parks claiming to be agents of the latter. In the event that the vehicle is returned without its keys and/or its driving documents, the duplicate will be invoiced to the Renter as well as, where applicable, the costs of repatriating the vehicle. The Lessor can under no circumstances be held liable for property that may have been left in the vehicles at the end of their return.

N.B: Only the taking possession of the vehicle, the documents and the keys by the STLV Hertz Tunisie agent, during the opening hours of the branch concerned, brings the rental agreement to an end.

Your liability remains engaged until the end of the rental agreement, namely by its return under the conditions set out above.

Exceptions:

In the event of confiscation or sealing of the vehicle, the rental agreement may be terminated automatically as soon as the Lessor is informed thereof by the judicial authorities or by the Renter.

- Any use of the vehicle that would be detrimental to the Lessor would authorise the latter to terminate the agreement automatically. – In the event of loss (theft, fire) of the vehicle, the rental agreement is stopped as soon as the complaint filed by the Renter with the competent authorities is sent to the Lessor.

- In the event of an accident, the rental agreement is stopped as soon as the joint accident report, duly completed by the Renter as well as by the party concerned by the accident in question, is sent to the Lessor.

You must provide us, with supporting documents, with all the information essential for drawing up your rental agreement, in particular: your identity, your address, your date and place of birth, the category and date of issue of your driving licence, the means of payment for your rental.

Age: Every driver must be at least 23 years old for City cars and 25 years old for compacts, SUVs and Saloons and must have held a valid driving licence for at least 24 months.

The driver's age may be revised upwards depending on the category of the rented vehicle.

The estimated cost of the rental and services is payable in cash and in advance. It includes: the rental price, calculated according to the rates in force at the time the agreement is signed; any fees, the cost of additional options requested by the Renter, to which the security deposit is added.

Payment by bank card:

For any payment made by means of a bank card, the main driver must be the cardholder.

However, for the amount of the security deposit, only an authorisation will be requested at the start of the rental.

On return, the amount of any balance of the invoice will be automatically debited from the account corresponding to the card presented unless the Renter presents another means of payment accepted by the Lessor.

The Renter hereby accepts the debit from this same account of all other charges that may be directly or indirectly related to the vehicle, its rental or the use made of it by the Renter (fuel, repairs, traffic tickets and fines, ...).

Security deposit:

The amount of the security deposit depends, on the one hand, on the category of the rented vehicle and, on the other hand, on the additional cover taken out. It is intended to cover the loss suffered by the Lessor as a result of damage to or theft of the vehicle that is the subject of the rental.

The amount will be equal to the amount of the Renters' liability ceiling, which differs according to the category of the vehicle made available and is indicated in the rental agreement.

The security deposit will be acquired by the Lessor in the event of damage attributable to the Renter or in the absence of fault of an identified third party and in the event of theft of the vehicle In the absence of damage and/or theft and of any other charges that may be directly or indirectly related to the vehicle, its rental or the use made of it by the Renter (fuel, repairs, traffic tickets and fines, tyres...), the amount of the security deposit actually paid will be refunded at the end of the rental, subject to the collection period.
